Reasons for Visa Cancellation Australia

A visa can only be granted, refused, or cancelled by the Minister or a representative of the Minister, and it can be optional, obligatory, or by operation of law. Character Grounds

If you fail to pass a “character test,” as described in section 501 (6) of the Migration Act 1958, your visa may be cancelled. The following are the reasons why you would not pass the test:

Have a criminal record of imprisonment of 12 months or more; or

Found guilty of a sexually based crime that involves a child; or

Have a connection to someone, a group, or an organization that is suspected of engaging in illegal activity.

You will be given 28 days to represent why the decision to cancel the visa should be revoked.

Paying for Sponsorship

The other reason to get your visa cancelled is if you are involved in the payment of visa sponsorship.

However, if you were involved in payment due to human trafficking, or threats. 

Changes to study

If your enrolment in a registered course has ended, your student visa will be revoked. In the following situations your visa might get cancelled:

Even after the course is completed you do not leave Australia or apply for any other visas.

You changed your course after receiving your student visa, and your key course ends sooner than expected, and you do not leave Australia or apply for any other visas within the next 28 days.

The things that are considered before cancelling your visa are:

You legitimately completed the course early.

Have a strong academic record.

it is fair to anticipate that you will enrol in another course during the course gap.

Failed to explain the reason you brought goods.

Do not obey the Biosecurity Officer’s instructions.

What should you do now the visa is cancelled?

If your visa is revoked, you will be unable to apply for new visas and prevent you from being issued such visas to travel, enter, or remain in Australia

If the visa is cancelled due to character grounds the only visa you can apply for is a Protection Visa. If you are expelled from Australia for reasons of character, you can find it difficult to pass the character test when applying for a new visa to re-enter the country.

Also, the Criminal Justice Entry visa candidates can apply for Protection Visa only.

If you’ve been denied a Protection visa after your last visit to Australia, you won’t be able to apply for one again.
